Terms of Service
By creating a CleverSets account, you agree to these Terms. If you do not agree, please do not use CleverSets.
1. The service
CleverSets is a personal-content-organization platform operated by Lysmata Systems, LLC ("Lysmata," "we," "us"), a Florida limited liability company. CleverSets offers tools to store, organize, and selectively share photos, videos, notes, contacts, and other personal items.
2. Your content stays yours
You retain full ownership of everything you upload. You grant us only the limited license we need to operate the service: to store your content, process it (for example, to create thumbnails and streaming versions of videos), and display it to you and to the people you choose to share it with.
We will never:
- sell your content or license it to anyone,
- use your content to train external AI models, or
- show advertising against your content — including content you publish publicly. We don't run ads, period.
3. Visibility tiers
Everything you put in CleverSets is private by default. You can additionally:
- Share with named people — specific people you choose see exactly what you grant them.
- Publish to a public link — anyone with the link can view, without an account.
What you share or publish is governed by the moderation rules below; what stays private is scanned only as the law requires (Section 5).
4. Acceptable use
You agree not to use CleverSets to:
- Upload child sexual abuse material (CSAM) or any content illegal under applicable US law.
- Make credible threats of violence, or incite violence.
- Publish hate speech — content that dehumanizes, threatens, or calls for discrimination against people based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age. (This is about attacks on people, not criticism of ideas.)
- Harass other people, or impersonate specific real people.
- Publish other people's private information with intent to harm ("doxxing").
- Commit fraud or engage in coordinated inauthentic behavior.
- Distribute malware, attempt to compromise the service, or bypass moderation, rate limits, or other technical controls.
- Scrape, copy, cache, store, republish, redistribute, resell, or train any machine-learning model on the web-search results that the AI assistant shows you (Section 8). Notes you write yourself, including links to the sources you found, are yours to keep and use normally.
5. Content moderation
We moderate based on demonstrable harm, with a strong preference for leaving your content alone. What we actually do:
- CSAM scanning (all uploads, every tier). US federal law (18 U.S.C. § 2258A) requires it. Every uploaded image and video is checked against an industry hash-list of known CSAM (Microsoft PhotoDNA). A positive match results in immediate account lock, preservation of the matched content in a restricted-access vault for federal reporting to the National Center for Missing & Exploited Children (NCMEC), and a report to NCMEC as the law requires. Hash-matching identifies only known, verified CSAM — it does not "look at" your photos in any broader sense, and nothing else about private content is scanned.
- Publishing to a public link additionally runs an automated content-safety check (for severe hate, sexual, violence, and self-harm content). Severely violating content is blocked from publishing; borderline content publishes normally and enters our human review queue.
- Reports. Anyone viewing public content can report it. Reports are reviewed by a human.

Enforcement and appeals
Most violations follow an escalating path: warning and content removal with a 24-hour suspension first, then 7-day and 30-day suspensions, then permanent termination. Strikes expire after 12 months. Severe violations — CSAM, credible threats of violence, doxxing with demonstrable intent, repeated impersonation of specific real people — result in immediate permanent termination.
Except for CSAM (where the law controls), you may appeal any removal or suspension within 14 days through the in-app support form. A human reviews every appeal and replies with a written rationale.
If your account is terminated for cause (other than CSAM), you have a 30-day window to request an export of your content before deletion.
6. Federation and content from other servers
CleverSets can connect to the wider "fediverse" — a network of independent servers (Mastodon and others) that exchange posts using an open standard called ActivityPub. This is off by default. You turn it on per account in your settings, and you can turn it off again at any time.
When you enable it and publish a public post: we deliver that post to servers we don't operate, so that people who follow you from those servers can see it. Once a post has been delivered, we can ask remote servers to remove it if you edit or delete it, but we cannot guarantee they will — content that has left CleverSets is outside our control. Only public posts are ever federated; nothing private, and nothing you share with named people, is sent to other servers.
When you follow an account on another server: the posts you see from that account are written by that person and hosted on their server, not ours. We display them to you and may store a copy (including copies of attached images) so your feed loads reliably. That content belongs to whoever created it; we don't claim it, and we're not responsible for its accuracy or views.
Moderation of content from other servers. We apply the same baseline rules to content we store from elsewhere as to content uploaded here: any image or video we cache is scanned for CSAM (Section 5), and we remove content that violates Section 4. We may also block an entire remote server or account ("defederation") when it is a repeated source of illegal or abusive material — this stops new content from it and removes what we've cached. If you report a federated post, we act on the copy we hold; we may not be able to affect the original on its home server.
You are never penalized for what an account you follow chooses to post. Enforcement targets the content and its source, not the person who happened to follow it.
7. Subscriptions and billing
CleverSets offers a free tier and one or more paid subscription tiers with larger storage, sharing, and AI-feature allowances. The available tiers, their current prices, and what each one includes are shown on our pricing page; the summary shown to you when you subscribe is the one that applies to you.
- Billing is handled by Stripe, our payment processor. We never see or store your full card number.
- Monthly and annual billing are both available. Subscriptions renew automatically until you cancel.
- Cancel any time through the self-service billing portal. Cancellation takes effect at the end of the period you've paid for; you keep your paid features until then. We don't do cancellation phone calls, retention flows, or hidden buttons.
- If a renewal payment fails, your paid features continue for a 14-day grace period while we retry. If payment isn't resolved, your account moves to the free tier — your content is never deleted because of a billing lapse, though content over the free tier's limits may become read-only until you resubscribe or reduce usage.
- Credit and bandwidth top-up packs are one-time purchases. Spent credits are not refundable; unused purchases may be refunded case by case — contact support.
- Price changes will never apply retroactively to a period you've already paid for, and we'll give you notice before any price increase takes effect on renewal.
8. AI features
AI-assisted features — for example, captioning and alt-text, text recognition (OCR), description-based and semantic search, organization and planning suggestions, researching the public web on your behalf, and grouping similar faces — are off by defaultand opt-in. You enable them explicitly in Settings, and you can see exactly what was extracted from each item — and exclude any individual item — at any time.
When enabled, your content is processed within our own Azure cloud environment. We do not send your photos or videos to third-party face-identification services, we do not identify strangers, and we do not use your content to train external models. Turning AI assistance off deletes the derived data (such as face groupings, recognized text, and generated captions) for your account.
Some AI features can research the public web on your behalf — for example, to look up prices or options for items on a list. These are opt-in each time you use them. When you do, only the specific search terms needed — such as the names of the items you ask us to research — are sent to a third-party search provider (Brave Search) to fetch public results; we do not send your photos, note contents, contacts, or account identity. The provider returns public web content, which you review before anything is saved, and its handling of those search terms is governed by its own terms. What you may do with those results is covered in Section 4.
9. Legacy contacts
You can designate up to three legacy contacts in Settings → Legacy and choose what should happen to your account if you die or become incapacitated: export to your contacts, memorialize, or delete after a grace period. This designation is the controlling instruction under applicable digital-assets law (RUFADAA). If you designate no one, we retain your content and lock the account pending lawful instructions through your estate.
10. Where CleverSets is available
CleverSets is operated from the United States and intended for US-domiciled users at launch. We may refuse or restrict service in jurisdictions where compliance with local law would impose disproportionate operational burden.
11. Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
Most concerns are resolved quickly by contacting support. For anything that isn't, you and Lysmata Systems, LLC agree to resolve disputes through binding individual arbitration rather than in court, and both sides waive any right to a jury trial or to bring or join a class action. Two exceptions: either side may bring a qualifying claim in small-claims court, and you may opt out of this arbitration agreement by emailing support@cleversets.com within 30 days of first accepting these Terms — opting out does not affect any other part of these Terms.
12. Account termination
We may suspend or terminate accounts as described in Section 5.
You may delete your account at any time, in the app (Settings → Delete account) or on the web (Profile). Deleting your account cancels any paid subscription immediately, deactivates the account right away (your profile and content stop being visible to others), and permanently purges your data after a 14-day graceperiod during which you can sign back in and cancel the deletion. Groups you own are deleted with your account. Messages you already sent remain with their recipients, attributed to a deleted account. Your handle is permanently retired and never reissued. Deletion follows the retention rules in the Privacy Policy.
13. Copyright (DMCA)
We respond to copyright takedown notices under the DMCA. Send notices to our designated copyright agent, Lysmata Systems, LLC, at support@cleversets.com. Our DMCA page describes the information a valid notice must include and how the counter-notice process works.
14. Disclaimers and liability
CleverSets is provided "as is." To the maximum extent permitted by law, Lysmata Systems, LLC disclaims implied warranties and limits its total liability to the greater of the amount you paid us in the twelve months before the claim or US $100. Nothing in these Terms limits liability that cannot lawfully be limited.
15. Changes to these Terms
We may update these Terms as CleverSets changes or as the law requires. Every version is numbered and dated, and earlier versions stay available at their own links, so you can always see what changed and when.
When we publish a new version we'll ask you to accept it before you continue using CleverSets, and we'll keep a record of that acceptance. We do this for every version, including small corrections, so that what you agreed to is always exactly what's published.
If you don't want to accept a material change, you can export your content and close your account under Section 12.
